Me too.  Here is a visual flow chart of the litigation process.  It is prepared specifically for Queensland based individuals/entities.

Legal Proceedings Timeline

The above chart and timeframes are governed by the Uniform Civil Procedure Rules (Qld) 1999, 2001 年公司法(聯邦)Bankruptcy Act 1966 (Cth) and their associated regulations.

While useful for visual purposes, the timeframes are not necessarily absolute and each rectangle has its own legal consequences and requires tailored legal advice.  For example and using the:

(a) “Serve Statement of Claim” rectangle – there various methods service may be performed if personal service (preferred method for an individual) is not achieved;

(b) “No Defence Filed” and “Default Judgment” rectangles – there is an ability (for a defendant) to apply to the court to set aside a default judgment obtained if a defence was not filed within 28 days.

Hopefully the flowchart of itself clarifies some queries you may hold regarding the litigation process.

Please feel free to contact 安東尼·科科拉斯 on 07 3839 8011 should you wish to discuss where you sit on the flowchart, your next steps and associated legal issues.
