Un fornitore di credito o un finanziatore far\u00e0 affidamento sulla clausola di addebito per presentare un caveat sui terreni di propriet\u00e0 del debitore\/garante quando un debitore \u00e8 inadempiente.<\/p>\n

Una volta presentato un avvertimento, cosa c'\u00e8 dopo?<\/p>\n

 <\/p>\n

Un fornitore di credito o un finanziatore che ha una clausola di addebito in un contratto\/garanzia di credito o finanziamento:<\/strong><\/p>\n

    \n
  1. \u00e8 creditore privilegiato del debitore\/garante;<\/li>\n
  2. ha la garanzia sui terreni di propriet\u00e0 del debitore\/garante sotto forma di onere equo.<\/li>\n<\/ol>\n

     <\/p>\n

    Un fornitore di credito o un finanziere pu\u00f2 imporre un onere equo sui terreni di propriet\u00e0 del debitore\/garante chiedendo a un tribunale che il terreno venga venduto da:<\/strong><\/p>\n

      \n
    1. il prestatore creditore;<\/li>\n
    2. uno o pi\u00f9 ricevitori.<\/li>\n<\/ol>\n

      Questo \u00e8 un modo efficace per recuperare denaro a causa del fornitore di credito.<\/p>\n

       <\/p>\n

      scenario 1<\/strong><\/p>\n

      Clausola di addebito in una garanzia.<\/p>\n

      Il finanziere ha depositato una diffida contro i terreni di propriet\u00e0 del garante.<\/p>\n

      Il garante \u00e8 fallito.<\/p>\n

      Il finanziere ha imposto un onere equo sui terreni di propriet\u00e0 del garante chiedendo al tribunale la vendita del terreno da parte del finanziere.<\/p>\n

      Il finanziere ha venduto il terreno all'asta. Il terreno \u00e8 stato venduto all'asta per $860.000,00, $60.000,00 al di sopra del valore di mercato del terreno.<\/p>\n

      Il finanziere \u00e8 stato pagato per intero (debito + interessi + spese a titolo di indennizzo pieno) alla definizione del contratto di vendita del terreno.<\/p>\n

      La vendita del terreno ha generato proventi netti eccedenti per la somma di $128.018,30 (eccedenza<\/strong>). Il finanziere ha versato l'Eccedenza al curatore fallimentare del garante a beneficio dei creditori chirografari del garante.<\/p>\n

       <\/p>\n

      Scenario 2<\/strong><\/p>\n

      Clausola di addebito nel contratto di finanziamento.<\/p>\n

      Il finanziere ha depositato diffida contro 3 appezzamenti di terreno, uno di propriet\u00e0 esclusiva del debitore e gli altri due di propriet\u00e0 del debitore congiuntamente al coniuge del debitore (Propriet\u00e0<\/strong>).<\/p>\n

      Il finanziere ha imposto un onere equo sulle Propriet\u00e0 richiedendo a un tribunale la vendita delle Propriet\u00e0 da parte del finanziere e dei curatori.<\/p>\n

      Il tribunale ha disposto la vendita degli immobili da parte del finanziere e dei curatori.<\/p>\n

      Il debitore ha stipulato un accordo di pagamento con il finanziere per pagare l'importo dovuto al finanziere insieme agli interessi e alle spese sulla base di un indennizzo pieno per evitare che gli Immobili vengano venduti dal finanziere e dai curatori.<\/p>\n
